Terms of Service
These Terms of Service (“Terms”) govern your use of the Novingly website (novingly.com) and related services (the “Service”), operated by Novingly (“we”, “us”, or “our”). By using the Service, you agree to these Terms.
If you do not agree, do not use the Service.
1. The Service
Novingly is a web-based static-analysis tool for public source code repositories. You provide a public GitHub URL; the Service reads files from the public GitHub API and returns an automated security report and trust score. The Service may also offer paid features such as a “Verified by Orion” badge or a done-for-you remediation audit.
The Service is provided “as is.” Reports are automated and may contain false positives or miss real issues. The Service is informational only and does not constitute a security audit, legal advice, or a warranty of any kind.
2. Acceptable Use
You agree not to:
- Use the Service to scan repositories you do not have a lawful right to access.
- Reverse-engineer, scrape, or attempt to disrupt the Service.
- Use the Service to harass, defame, or extort the maintainer of any scanned repository.
- Use the Service in violation of any applicable law.
3. Paid Services
Some features require payment. Prices and descriptions are listed on our pricing page. Payment is processed by a third-party merchant of record. Subscription terms (renewal, cancellation) are disclosed at checkout.
Refund eligibility is governed by our Refund Policy.
4. Intellectual Property
The Novingly site, brand, and rubric are the property of Novingly. Scan reports we generate about your repository are yours to use, share, or republish.
We do not claim ownership of, and we do not store, the source code of any repository we scan. We retain only the metadata needed to render the report (file path, line number, snippet, category, severity).
5. Limitation of Liability
To the maximum extent permitted by law, Novingly is not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising out of your use of the Service. Our total aggregate liability for any claim relating to the Service is capped at the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) one hundred U.S. dollars ($100).
6. Termination
We may suspend or terminate your access to the Service at any time if we believe you have violated these Terms. You may stop using the Service at any time.
7. Changes
We may update these Terms. The current version will always be at this URL with an “effective” date at the top. Continued use of the Service after a change means you accept the updated Terms.
8. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws rules.
